THE military governments of Burkina Faso, Mali and Niger have jointly declared their intention to leave the International Criminal Court (ICC), denouncing it as a ‘neo-colonial instrument of repression’.
In a statement released on Monday, the three nations—ruled by juntas since coups between 2020 and 2023—said the Hague-based tribunal had ‘proven itself incapable of handling and prosecuting proven war crimes, crimes against humanity, crimes of genocide, and crimes of aggression’.
One-year notice to the UN
Under ICC procedures, a withdrawal becomes effective one year after a country formally notifies the UN secretary-general. Until then, the court retains jurisdiction over cases that arose during each country’s membership.
The governments said they plan to develop ‘indigenous mechanisms for the consolidation of peace and justice’ to replace the ICC’s oversight.
Strategic pivot away from the West
Since seizing power, the three Sahel states have tightened their alliance under the Alliance of Sahel States (AES) and steadily distanced themselves from Western powers, particularly former colonial ruler France. Their growing ties with Russia underscore this shift; Moscow’s president, Vladimir Putin, has faced an ICC arrest warrant since March 2023 for alleged war crimes in Ukraine.
Ongoing conflicts and allegations
Burkina Faso, Mali and Niger continue to battle violent insurgencies linked to Al-Qaeda and the Islamic State. Rights groups have repeatedly accused their armed forces of abuses against civilians, allegations the juntas deny.
ICC’s global mission
Established in 2002, the ICC was designed to prosecute perpetrators of the world’s most serious crimes when national authorities are unwilling or unable to act. The departure of three Sahel nations adds to a list of African countries that have long criticised the court for what they describe as a disproportionate focus on the continent.
